Obligation to provide information as part of the responsibility principle

How should the information be provided?

Information can be provided in a variety of ways.

Employers and organisations are especially encouraged to use existing technology to communicate information.

The main emphasis is that the information should be in a concise, transparent, understandable and accessible form. This includes avoiding sentences such as “we may gather information about you in the following cases...”

Information should also be in a clear and simple language and be separate from other matters, such as general contractual terms.

It is also important to ensure that notifications of updates on information, for example in the data protection policy, are not mixed with other items, for example offers of products, when sending an e-mail.

This is especially important when information is specifically directed at a child.

The information shall be provided in writing or in other forms, including in electronic form.

The information shall then be provided to the data subject free of charge.
