Child custody emphasizes the care and protection aspects of parental responsibilities. Custody includes both the right and obligation for a parent to manage the personal affairs of the child, and the child has the right to be under the custody of one or both parents.

Custody can be joint or held by one parent. Parents who have children within a marriage or registered cohabitation share joint custody of their children.

If a child is born outside of marriage or registered cohabitation, the mother alone has custody.

Cooperation after divorce

Attention is drawn to the SES (Cooperation after Divorce) service, which provides courses for parents and children as well as specialized counseling offered by municipalities, including issues of custody and visitation. More information can be found on the website www.samvinnaeftirskilnad.is.
