Child support
Agreement on child support
If a child has permanent residence with one of the parents, the parents can agree that the other parent fulfills their financial support obligation by paying child support.
Parents cannot agree on a monthly child support amount lower than the basic child support. The parents' agreement on child support can be temporary, but there must be an agreement between the parents on the child's financial support until the age of 18. The financial support obligation cannot be limited to a child's age lower than 18.
Basic child support is often referred to as minimum child support. The amount of basic child support is equal to the child benefit and is reviewed annually.
Parents are also free to agree on additional child support if the child has permanent residence with one of the parents. Additional child support refers to amounts higher than the minimum or basic child support.
Parents are not required to seek confirmation from the district commissioner for their child support agreement. However, the district commissioner's confirmation has the following effects:
The parent with whom the child resides can seek enforcement against the non-custodial parent for unpaid child support.
The custodial parent can request the State Social Security Institute (Tryggingastofnun) to mediate payments of basic child support according to the parents' agreement. Mediation by the State Social Security Institute is not available for additional child support. The district commissioner in Northwest Iceland collects child support.
The child support payer can request that the district commissioner rule on the termination or reduction of additional child support if circumstances change and the conditions for additional child support no longer apply.

As of January 1, 2022, parents are allowed to agree on the financial support of a child without child support payments. This includes the condition that the custodial parent cannot request the mediation of the State Social Security Institute for payments concerning the child's financial support.
