Compliance monitoring
The role of the Data Protection Officer is to assist companies with internal control, inform and advise on the data protection legislation, provide advice on the implementation of an impact assessment on data protection, as well as being a contact point for individuals and the Data Protection Authority.
In order to monitor compliance and assist controllers and processors in complying with the Data Protection Regulation, the data protection officer must in particular:
gather information to analyse the processing,
identify and monitor compliance in the activities,
inform, advise and make proposals to the sponsor or processor.
Responsibilities of the Data Protection Officer
It is the responsibility of the company or the administration to ensure and be able to demonstrate that the processing of personal data by them is in accordance with the rules.
The Data Protection Officer is not personally responsible if the provisions of the Data Protection Act are not complied with. However, he or she may be liable for criminal damage if he or she commits serious breaches of confidentiality.
