Residence permit for parents and children in illegal stay

Parents and children who applied for international protection before 1 August 2021 and are still in Iceland can apply for a special residence permit.

With an amendment to the Foreign Nationals Act parents and children, who applied for international protection in Iceland before 1 August 2021 and are still here, can apply for a special temporary residence permit in Iceland.

The right applies to legal guardians and their children, under the age of 18, who

  • applied for international protection in Iceland before 1 August 2021 and are still here, or

  • were born in Iceland while an application for international protection from their legal guardians, received before 1 August 2021, was being processed.

The application must be received by the Directorate of Immigration before 5 July 2023. The application is free of charge, but an insurance certificate must be submitted, confirming that applicants have purchased a health insurance for themselves and their children.
