The Data Protection Authority's powers under the Data Protection Act in matters relating to individual monitoring

The use of CCTV in neighbourhood monitoring may result in the processing of personal data that falls within the scope of the Data Protection Act. However, The Data Protection Authority does not generally use its powers to order individuals to take down cameras or enter a home or private property to investigate the field of vision of CCTV. This is in accordance with the principle of proportionality which states that the government must be proportionate in the use of its powers and is obliged to consider the objective that its work aims to achieve and to take into account the interests and rights of the parties against whom the acts and use of force are directed.
