Duties of an Appointed Guardian
A guardian must carry out their duties in the best interest of the ward (the person under guardianship) at all times. The guardian should consult with the ward regarding their duties whenever possible, except in cases involving minor decisions.
If the individual has been deprived of legal capacity (self-determination)
The guardian of an individual who has been deprived of legal capacity has the authority to make necessary decisions about the person's personal matters that they are unable to make themselves. These decisions are binding as if the individual had made them themselves.
The guardian of a person deprived of legal capacity must submit a report on the ward to the district commissioner every 12 months.
If the individual has been deprived of financial capacity
The guardian of an individual deprived of financial capacity manages their finances unless otherwise stated by law.
The guardian of a person deprived of financial capacity must submit a report to the district commissioner by April 1 each year, detailing the main decisions made regarding the ward's assets during the previous year.
